The MEC for Cooperative Governance and Traditional Affairs (CoGTA) in KwaZulu-Natal, Reverend Thulasizwe Buthelezi has scored another legal victory against the executive of Nongoma Local Municipality.
This is after the Pietermaritzburg High Court set aside the appointment of Nhlakanipho Zulu as the Municipal Manager (MM) for the municipality.
The court also set aside the appointment of Mzwandile Dube as the Chief Financial Officer (CFO) in the same municipality.
The application was brought by Buthelezi in September this year alleging that Zulu lied on his CV and he left one of the municipalities in the province after it was recommended that he should be charged for alleged corruption.
Buthelezi also alleged that Dube was not suitably qualified for the position in a financially troubled municipality like Nongoma, but the ANC, EFF and NFP alliance appointed him.
Before this legal battle, Buthelezi took the council to court to set aside its decision to extend the acting sting of Sipho Nkosi as the municipal manager.
The executive of the municipality, led by Mayor Clifford Ndabandaba and Speaker Babongile Sithole, had rammed through Nkosi’s appointment even though CoGTA warned it was against the law.
Ruling on the Zulu and Dube matter, the court said the municipality should comply with the ruling and should not appoint Zulu and Dube to the positions in future.
The municipality was also instructed to follow the municipal systems act and seek secondment from Buthelezi for suitably qualified candidates to fill up the positions.
